Yes folks! At last we have found a way to make an appeal against an HMRC decision and to get THEM to a tribunal. Legal advisors to AGCO and several proprietary clubs have been scratching their heads as to how to achieve this for 15 years. Now your team of amateur detectives and volunteer solicitors have cracked it. We are off and running. The appeal is being taken on behalf of AGCO, two proprietary clubs and a members’ club. HMRC has until August 5th to file their defence to our appeal. It centres about the seemingly trivial matter of affiliation fees. But the whole aim is to get the VAT distortion issue resolved and if necessary onwards and upwards to Europe. Remember we have the Chipping Sodbury decision under our belts – a finding of fact by the judges that there is distortion between members’ clubs and proprietary clubs.
