As you know Bridport and West Dorset Golf Club, plus 457 other clubs, got a ruling in Europe that they should be refunded their VAT on green fees going back to 1990. HMRC confirm the claims are over £115 million. The English Golf Union supported and probably started all this with KPMG in 2008. They have urged all other member-owned golf clubs to make claims. The total claims look like being over £500 million. HMRC eventually said they would fight this on the basis of unjust enrichment. In other words the clubs will keep the refunds and can’t give it back.
But your team of moles and whistle-blowers at AGCO have another answer to the £500 million heist. The VAT exemption is for supplies by non-profit making organisations to persons – individuals! And guess what? Bridport and KPMG forgot to tell the judge that lots of the “green fees” were for societies and corporate days; 47 at Bridport conveniently hidden from the Court. And then lots of the supplies aren’t by the clubs themselves but by agents like teeofftimes and golfbreaks acting for the clubs. And they aren’t non-profit making organisations. We say it is fraud on the part of the whole member-owned golf club community. We have told HMRC and applied the High Court to submit new evidence. The Judge will likely throw us out. But who cares?
