VAT and Tax update for all AGCO supporters and members
AGCO VAT TRIBUNAL, LONDON – March 23rd to 26th
AGCO has eventually managed to get HMRC to Court over the VAT distortion in sport. It’s our case against them. The case is supported by 26 witnesses from golf and sports clubs in England, Northern Ireland and Wales. We will be represented by a barrister from Monckton Tax Chambers. It’s quite technical. But our ultimate aim is to get the VAT distortion issue to Europe. It should also sort those mandatory affiliation fees! Phone Vivien – 07956 628338 – for details and come to support the case!
VAT CASE to EUROPEAN COMMISSION – DISTORTION
AGCO has an application in front of the European Commission asking them to take proceedings against the United Kingdom Government because of the VAT distortion in UK sport. Thanks to financial contributions from AGCO supporters we were able to support this with an excellent counsel’s opinion from leading tax barrister, Valentina Sloane, from Monckton Chambers. Our case number in Brussels is CHAP(2015)00636. We have also supported this with witness statements from golf/sports clubs in England, Northern Ireland and Wales, which have suffered from cases with HMRC. The European Commission will take over our case and determine whether the UK’s VAT rules on sport are against EU law. You can see examples of where the Commission takes action against countries. For example they have challenged the Netherlands over the VAT treatment of water sports. This is a link to see the process with the Netherlands. http://europa.eu/rapid/press-release_IP-14-1040_en.htm. You can see the types of cases taken against Member States! It is one way of getting the UK to the European Court of Justice. http://ec.europa.eu/taxation_customs/common/infringements/infringement_cases/bycountry/index_en.htm Well done everyone from AGCO who has made this happen!
Many thanks for all those club owners that have contributed to the counsel’s opinion for Europe and underwritten the barrister’s fees for London. There has been a team of more forty people – all volunteers – involved in these cases.
